In 2002, the Southland Farmers' Market Association worked with the California
Department of Food and Agriculture's Certified Farmers' Market Advisory
Committee to develop emergency regulations to deal with the challenge
posed by unregulated partnerships in certified farmers' markets. On February
4, 2002, the California Department of Food and Agriculture (CDFA) adopted
emergency regulations to deal with this problem until permanent regulations
could be considered and adopted.
Southland Farmers' Market Association helped to draft and actively supported
the emergency regulations that establish new requirements for partnerships
that wish to sell at certified farmers' markets. The regulations provide
a definition of partnership that requires it to be a separate entity from
its individual members. As a separate entity, a partnership must obtain
a certified producer's certificate to market its agricultural products.
To produce these products, the partnership must practice the agricultural
arts upon the land that the partnership exclusively controls.
CDFA has proposed that these emergency regulations be made permanent.
The Department will receive comments on the proposed regulations until
April 24, 2002.
